What is the applicable regulatory framework?<\/h2>\n<h3 data-start=\"567\" data-end=\"618\">1.1. The European framework (MiCA Regulation)<\/h3>\n<p data-start=\"619\" data-end=\"754\">The MiCA Regulation introduces, for the first time, a unified regulatory framework for crypto-asset markets across the EU, aiming to:<\/p>\n<ul data-start=\"755\" data-end=\"879\">\n<li data-start=\"755\" data-end=\"777\">\n<p data-start=\"757\" data-end=\"777\">protect investors,<\/p>\n<\/li>\n<li data-start=\"778\" data-end=\"819\">\n<p data-start=\"780\" data-end=\"819\">enhance transparency and supervision,<\/p>\n<\/li>\n<li data-start=\"820\" data-end=\"879\">\n<p data-start=\"822\" data-end=\"879\">prevent regulatory fragmentation between Member States.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"881\" data-end=\"1018\">Certain categories are excluded from its scope, such as unique and non-fungible crypto-assets (NFTs), deposits, and insurance products.<\/p>\n<h3 data-start=\"1020\" data-end=\"1050\">1.2. Greek Law 5193\/2025<\/h3>\n<p data-start=\"1051\" data-end=\"1112\">With Law 5193\/2025, which adapts Greek legislation to MiCA:<\/p>\n<ul data-start=\"1113\" data-end=\"1390\">\n<li data-start=\"1113\" data-end=\"1182\">\n<p data-start=\"1115\" data-end=\"1182\">the <strong data-start=\"1119\" data-end=\"1127\">HCMC<\/strong> was designated as the competent authority for CASPs,<\/p>\n<\/li>\n<li data-start=\"1183\" data-end=\"1288\">\n<p data-start=\"1185\" data-end=\"1288\">sanctions were introduced for the professional provision of services without a license (Article 107),<\/p>\n<\/li>\n<li data-start=\"1289\" data-end=\"1390\">\n<p data-start=\"1291\" data-end=\"1390\">measures were provided for the protection of investors and whistleblowers (Articles 102 and 114).<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1392\" data-end=\"1489\">At the same time, CASPs remain subject to compliance obligations under <strong data-start=\"1463\" data-end=\"1486\">AML\/CFT legislation<\/strong>.<\/p>\n<h2 data-start=\"1491\" data-end=\"1549\">2. What changes with HCMC Decision 8\/1059\/30.07.2025?<\/h2>\n<p data-start=\"1550\" data-end=\"1731\">For the first time in Greece, a clear and standardized procedure is established for licensing businesses that provide services related to cryptocurrencies and other crypto-assets.<\/p>\n<h3 data-start=\"1733\" data-end=\"1777\">2.1. Key elements of the new procedure<\/h3>\n<h4 data-start=\"1779\" data-end=\"1815\">2.1.1. Preliminary assessment<\/h4>\n<p data-start=\"1816\" data-end=\"1943\">Applicants may request a preliminary meeting with the HCMC to prepare more effectively before filing an official application.<\/p>\n<h4 data-start=\"1945\" data-end=\"1988\">2.1.2. Submission of the application<\/h4>\n<p data-start=\"1989\" data-end=\"2109\">The application must be accompanied by specific supporting documents and standard forms already published by the HCMC.<\/p>\n<h4 data-start=\"2111\" data-end=\"2147\">2.1.3. Assessment of the file<\/h4>\n<ul data-start=\"2148\" data-end=\"2377\">\n<li data-start=\"2148\" data-end=\"2203\">\n<p data-start=\"2150\" data-end=\"2203\">Receipt is acknowledged within <strong data-start=\"2181\" data-end=\"2200\">5 business days<\/strong>.<\/p>\n<\/li>\n<li data-start=\"2204\" data-end=\"2268\">\n<p data-start=\"2206\" data-end=\"2268\">Completeness check is concluded within <strong data-start=\"2245\" data-end=\"2265\">25 business days<\/strong>.<\/p>\n<\/li>\n<li data-start=\"2269\" data-end=\"2377\">\n<p data-start=\"2271\" data-end=\"2377\">The final licensing decision is issued within <strong data-start=\"2317\" data-end=\"2337\">40 business days<\/strong> from acceptance of the complete file.<\/p>\n<\/li>\n<\/ul>\n<h2 data-start=\"2379\" data-end=\"2404\">3. Practical example<\/h2>\n<p data-start=\"2405\" data-end=\"2520\">A Greek company that already operates a cryptocurrency exchange and wishes to expand into other EU Member States:<\/p>\n<ul data-start=\"2521\" data-end=\"2710\">\n<li data-start=\"2521\" data-end=\"2570\">\n<p data-start=\"2523\" data-end=\"2570\">requests a preliminary meeting with the HCMC,<\/p>\n<\/li>\n<li data-start=\"2571\" data-end=\"2609\">\n<p data-start=\"2573\" data-end=\"2609\">submits a complete licensing file,<\/p>\n<\/li>\n<li data-start=\"2610\" data-end=\"2710\">\n<p data-start=\"2612\" data-end=\"2710\">once licensed, can provide services across the EU through the <strong data-start=\"2674\" data-end=\"2697\">\u201cEuropean passport\u201d<\/strong> mechanism.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2712\" data-end=\"2836\">Thus, licensing serves not merely as a regulatory obligation, but as a <strong data-start=\"2783\" data-end=\"2833\">passport for growth and cross-border expansion<\/strong>.<\/p>\n<h2 data-start=\"2838\" data-end=\"2882\">4. What should interested companies do?<\/h2>\n<p data-start=\"2883\" data-end=\"2949\">Businesses wishing to operate as CASPs in Greece are advised to:<\/p>\n<ol data-start=\"2950\" data-end=\"3433\">\n<li data-start=\"2950\" data-end=\"3048\">\n<p data-start=\"2953\" data-end=\"3048\"><strong data-start=\"2953\" data-end=\"2963\">Assess<\/strong> whether their services fall under MiCA, based on the Regulation and Law 5193\/2025.<\/p>\n<\/li>\n<li data-start=\"3049\" data-end=\"3153\">\n<p data-start=\"3052\" data-end=\"3153\"><strong data-start=\"3052\" data-end=\"3063\">Prepare<\/strong> the required documentation (corporate structure, business plan, compliance mechanisms).<\/p>\n<\/li>\n<li data-start=\"3154\" data-end=\"3245\">\n<p data-start=\"3157\" data-end=\"3245\"><strong data-start=\"3157\" data-end=\"3169\">Consider<\/strong> requesting a preliminary meeting with the HCMC to facilitate the process.<\/p>\n<\/li>\n<li data-start=\"3246\" data-end=\"3339\">\n<p data-start=\"3249\" data-end=\"3339\"><strong data-start=\"3249\" data-end=\"3259\">Submit<\/strong> the licensing application following the instructions of Decision 8\/1059\/2025.<\/p>\n<\/li>\n<li data-start=\"3340\" data-end=\"3433\">\n<p data-start=\"3343\" data-end=\"3433\"><strong data-start=\"3343\" data-end=\"3359\">Keep in mind<\/strong> the relevant deadlines (up to 40 business days for the final decision).<\/p>\n<\/li>\n<\/ol>\n<h2 data-start=\"3435\" data-end=\"3453\">5. Conclusion<\/h2>\n<p data-start=\"3454\" data-end=\"3668\">With the combined application of the <strong data-start=\"3491\" data-end=\"3510\">MiCA Regulation<\/strong>, <strong data-start=\"3512\" data-end=\"3529\">Law 5193\/2025<\/strong>, and <strong data-start=\"3535\" data-end=\"3564\">HCMC Decision 8\/1059\/2025<\/strong>, Greece now has a <strong data-start=\"3583\" data-end=\"3621\">comprehensive regulatory framework<\/strong> for the crypto-asset market.
