{"id":893,"date":"2024-04-24T18:02:32","date_gmt":"2024-04-24T15:02:32","guid":{"rendered":"https:\/\/sgklegal.gr\/?p=893"},"modified":"2025-05-15T17:30:02","modified_gmt":"2025-05-15T14:30:02","slug":"gdpr-can-an-employer-be-exempt-from-liability-for-compensation-if-the-gdpr-violation-was-committed-by-their-employee","status":"publish","type":"post","link":"https:\/\/sgklegal.gr\/en\/gdpr-can-an-employer-be-exempt-from-liability-for-compensation-if-the-gdpr-violation-was-committed-by-their-employee\/","title":{"rendered":"GDPR: Can an employer be exempt from liability for compensation if the GDPR violation was committed by their employee?"},"content":{"rendered":"<div id=\"bannerR\">\n<p data-start=\"68\" data-end=\"372\"><strong data-start=\"68\" data-end=\"372\">The Court of Justice of the European Union, in the context of Case C-741\/21, examined, among other issues, whether a data controller may be exempted from liability for damage compensation by arguing that the breach of Regulation (EU) 2016\/679 (hereinafter \u201cGDPR\u201d) was due to an employee\u2019s negligence.<\/strong><\/p>\n<h3 data-start=\"374\" data-end=\"393\">Case Background<\/h3>\n<p data-start=\"395\" data-end=\"693\">The company <em data-start=\"407\" data-end=\"414\">juris<\/em> processes customer data both within the context of its legal information database service and for the commercial promotion of its services. GB, a lawyer and client of <em data-start=\"582\" data-end=\"589\">juris<\/em>, withdrew any consent he may have given for marketing communications, except for receiving newsletters.<\/p>\n<p data-start=\"695\" data-end=\"875\">Nevertheless, he received promotional materials at his professional address, prompting him to claim compensation for the damage suffered due to the unlawful processing of his data.<\/p>\n<p data-start=\"877\" data-end=\"1150\"><em data-start=\"877\" data-end=\"884\">juris<\/em> argued, among other things, that it had implemented a system for managing objections to direct marketing, and that the reason it failed to respect GB\u2019s objection in time was due to a failure by one of its employees or associates to follow the instructions provided.<\/p>\n<p data-start=\"1152\" data-end=\"1522\">The District Court of Saarbr\u00fccken (Germany) submitted a series of preliminary questions to the CJEU, including whether it is sufficient for a data controller to be exempted from liability for damages by arguing that the breach resulted from an error by a person acting under the authority of the controller or the processor, within the meaning of Article 29 of the GDPR.<\/p>\n<h3 data-start=\"1524\" data-end=\"1551\">What did the CJEU rule?<\/h3>\n<p data-start=\"1553\" data-end=\"1856\">Firstly, <strong data-start=\"1562\" data-end=\"1671\">any data controller is both administratively and civilly liable for the processing activities it performs<\/strong>. This liability extends to persons carrying out processing activities under the controller\u2019s authority, instructions, and supervision\u2014such as employees, agents, or other collaborators.<\/p>\n<p data-start=\"1858\" data-end=\"2067\">In general, Article 82(3) of the GDPR provides that <strong data-start=\"1910\" data-end=\"2066\">a controller may be exempt from liability for damages if they can prove that they are not in any way responsible for the event giving rise to the damage<\/strong>.<\/p>\n<p data-start=\"2069\" data-end=\"2363\">However, a controller must ensure the establishment and implementation of appropriate policies and procedures, so that any processing activity carried out by persons under its authority is done <strong data-start=\"2263\" data-end=\"2362\">strictly within the framework defined by the controller and in accordance with its instructions<\/strong>.<\/p>\n<p data-start=\"2365\" data-end=\"2785\">Therefore, <strong data-start=\"2376\" data-end=\"2569\">an employee&#8217;s error (i.e., a person acting under the controller&#8217;s authority) implies that the controller failed to ensure the proper implementation of the policies and procedures it adopted<\/strong>. As such, merely providing instructions is <strong data-start=\"2613\" data-end=\"2669\">not sufficient to exempt the employer from liability<\/strong> in cases where the employee failed to follow those instructions, resulting in a GDPR breach that led to the damage.<\/p>\n<p data-start=\"2787\" data-end=\"3064\">Accordingly, <strong data-start=\"2800\" data-end=\"2903\">employers\/data controllers cannot be exempted from liability by simply invoking employee negligence<\/strong>. The employer may only avoid civil liability by <strong data-start=\"2952\" data-end=\"2992\">proving that there is no causal link<\/strong> between the GDPR violation and the damage suffered by the data subject.<\/p>\n<p data-start=\"3066\" data-end=\"3298\">It is therefore clear that <strong data-start=\"3093\" data-end=\"3208\">compliance with data protection law cannot be achieved merely by the formal adoption of policies and procedures<\/strong>, especially when such measures remain unimplemented or are not communicated to employees.<\/p>\n<p data-start=\"3300\" data-end=\"3851\">On the contrary, it is necessary to <strong data-start=\"3336\" data-end=\"3392\">develop a culture of lawful personal data processing<\/strong> within organizations. This culture must be effectively communicated to employees and partners and be <strong data-start=\"3494\" data-end=\"3517\">regularly monitored<\/strong> for implementation. Hence, it is of <strong data-start=\"3554\" data-end=\"3578\">paramount importance<\/strong> both to design policies and procedures tailored to the specific needs of a given controller and to <strong data-start=\"3678\" data-end=\"3707\">train and raise awareness<\/strong> among employees not only about the general principles of data protection, but especially about these specific internal
